1. CALL TO ORDER and APPROVAL OF MINUTES Chairman Peterson called the meeting to order at 7 p.m. APPROVE MINUTES OF OCTOBER 28, 2004 MOTION by Hilda White, SECOND by Reg Gignoux, to approve the 10/28/04 minutes as written. VOTING: unanimous (7-0); motion carried.

2. DESIGN REVIEW APPLICATION, ROGER AND FRANCINE DUNN, 782 FALLS ROAD (DR04-24) Francine Dunn appeared on behalf of the application.

APPLICANT COMMENTS Ms. Dunn stated there are no further comments to add to the information in the staff report. Rick Peterson asked if the shed will be visible from the road. Ms. Dunn explained the shed will be slightly visible from Falls Road when driving towards Hinesburg.

STAFF REPORT The Planning Commission received a written staff report on the application, dated 11/11/04. Dean Pierce pointed out the Design Review Committee recommended the Planning Commission approve the application.

PUBLIC COMMENTS None.

DELIBERATION/DECISION Design Review, Shed, 782 Falls Road, Dunn (DR04-24) MOTION by Fred Schmidt, SECOND by Kay Kraushaar, to grant design review approval to Roger and Francine Dunn for the installation of a shed on property located at 782 Falls Road consistent with the plans submitted. VOTING: unanimous (7-0); motion carried.

3. DESIGN REVIEW APPLICATION, ALAN CLAYTON/CHERYL ROBBINS-DOOLEY [BLACKFLOWER CHOCOLATE], 40 SHELBURNE SHOPPING PARK (DR04-25) Charley Dooley appeared on behalf of the application.

APPLICANT COMMENTS Mr. Dooley stated there were no additional comments to add to the staff report. STAFF REPORT The Planning Commission received a written staff report on the application, dated 11/11/04. Dean Pierce noted the site of the chocolate shop was formerly occupied by the coin shop. There was discussion of the design of the sign and other signs on the building. It was noted the Design Review Committee recommended a sign of 16 s.f. in size to be more readable and communicate more effectively.

DELIBERATION/DECISION Design Review, Sign, 40 Shelburne Shopping Park, Clayton/Dooley [Blackflower Chocolate] (DR04-25) MOTION by Reg Gignoux, SECOND by Hilda White, to grant design review approval to Alan Clayton/Cheryl Robbins-Dooley [Blackflower Chocolate] for a sign to be located at 40 Shelburne Shopping Park consistent with the plan submitted and with the condition the dimensions of the sign may be increased proportionally to a total area of 16 square feet. VOTING: unanimous (7-0); motion carried.

4. SITE PLAN AMENDMENT, CHITTENDEN SOUTH SUPERVISORY UNION/SHELBURNE COMMUNITY SCHOOL, 345 HARBOR ROAD (SP00-3R2) Bob Mason, Lucy Cooney, and Dana Hirth appeared on behalf of the application.

APPLICANT COMMENTS Mr. Mason reviewed the area for a fenced play yard for the EEE preschool program. The play yard is adjacent to the classroom trailers located in the northwest corner of the school property. A snow fence was installed to meet state regulations, but the snow fence is only temporary. A picket fence to blend with the building and area is suggested. A four foot high picket fence from The Arbors was donated to the school.

DELIBERATION/DECISION Site Plan Amendment, Fenced Play Yard, 345 Harbor Rd., Shelburne Community School (SP00-3R2) MOTION by Kay Kraushaar, SECOND by Fred Schmidt, to approve the revised site plan submitted by the Chittenden South Supervisory Union/Shelburne Community School in connection with a proposal for the addition of a fenced play yard immediately adjacent to the previously approved mobile classrooms as depicted on plans submitted and subject to the following conditions: 1. The fence enclosing the proposed play yard shall be of a picket style and shall appear substantially similar to examples portrayed in photographs included with the application. 2. All other conditions of approval for the property unrelated to the above shall remain in effect. 3. Within 60 days of this approval, the property owner shall record a “Memorandum of Municipal Action” with the Shelburne Town Clerk’s office; this document will notify future property owners of the approval and conditions. VOTING: unanimous (7-0); motion carried.

5. OTHER BUSINESS, CORRESPONDENCE Town Plan Update Materials The Planning Commission reviewed materials from Mike Munson on the Town Plan update. The Commission wanted language added regarding the vision for the town. Dean Pierce will communicate this to Mike Munson.

6. ADJOURNMENT MOTION by Tucker Holland, SECOND by Fred Schmidt, to adjourn the meeting. VOTE: unanimous (7-0); motion carried. The meeting was adjourned at 7:30 p.m. Minutes respectfully submitted by M.E.Riordan, Recording Secretary.
